Law is on Australia's side

Australia is not doing anything illegal when they are enforcing the ban on whaling in its Antarctic waters. They are not threatening any international co-operation in the region.

The court injunction against Japanese whaling was obtained and Chris McGrath, one of the lawyers in the legal team, said that fears expressed that this could threaten the Antarctic Treaty System are unfounded.

In a statement he said: "The close and long-established diplomatic ties between Australia and other (ATS) contracting parties, such as the US and Japan, also suggest that these countries would accommodate Australia enforcing its laws against whaling in Antarctica. Viewed objectively, the risk that the ATS will be destroyed or severely destabilised by Australia enforcing its laws against Japanese whaling in Antarctica appears small and remote."
